Wedding Contract
Parties of Agreement
This agreement constitutes an order for wedding photography services, including taking wedding pictures as agreed to by both parties: Sarah Brianne Photography (The Photographer) and Contracting Party (Client). Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain the property of the Photographer and may be used for advertising, marketing, display, or any other purpose thought proper by the Studio. Shared copyright is guaranteed to the Client when images are provided as part of a purchased collection.
Exclusion of Services (Acts of God)
If the Photographer cannot perform this agreement in whole or in part due to an emergency, casualty, injury, acts of God or nature or terror, or other cause beyond the control of the parties or due to the Photographer’s illness or injury, then Sarah Brianne Photography will return all fees to the Client (s) but shall have no further liability with respect to this agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. Client(s) agree that an entire wedding cannot be replicated, reenacted, or repeated for the purpose of a re-shoot and limits the Studio’s liability to the amount paid under this contract.
Change of Date or Venue
The Photographer must be notified immediately of any changes in date, schedule, and location. Notifications of any changes can be made with a written notice via email for documentation. If there is a change to the date, confirmation of the new is subject to the availability of that date. If another person has already secured that date, the Photographer is unavailable for any reason, then the contract is canceled, and no refunds are allocated.
Binding Contract and Refund Policy
A signed contract and retainer are required to reserve the specified date and coverage. On signing of this agreement by both parties hereto, the Studio will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all deposits and payments are non-refundable even if the date is changed or the wedding is canceled for any reason. Cancellation of a wedding directly affects the income potential of Sarah Brianne Photography. For this reason, Sarah Brianne Photography cannot issue refunds in the event of cancellation as a result of the actions of the Client.
If, within 6 (six) months of the wedding date, the Client attempts to cancel this contract; the Client is responsible for FULL PAYMENT of the contract and any court/lawyer fees associated with the retrieval of payment. Sarah Lyle, representing Sarah Brianne Photography, has, in good faith, held the agreed-upon date since the signing of this contract, and canceling this contract directly impacts Sarah Brianne Photography's annual salary.
Shared Copyright
Shared copyright implicitly allows clients to print photos at any photography reproduction service of their choosing when a digital share link has been provided by Sarah Brianne Photography or supplied as part of a collection. This signed contract shall serve as evidence of the right for clients to print images from the share link.
Retainer & Payments
A nonrefundable retainer of $500 is due at the signing of this agreement to secure your date and time of the wedding. The retainer is applied towards the final contracted wedding package and is not in addition to the package chosen. Final payment and all other expenses (additional image processing, parking, fuel, travel, taxi, hotel charges, etc.) are to be paid no later than 10 days prior to the event. A late payment fee of $250 applies.
Exclusivity
Sarah Brianne Photography and her associates shall be the exclusive photographer(s) retained by the client for the purpose of photographing the wedding. Family and friends of the clients and other wedding vendors shall not interfere with the photographer’s duties. Guests will be asked to refrain from taking flash photographs at certain intervals of wedding services to ensure proper exposure of images. Additional professional photographers may be employed only with prior written permission from Sarah Brianne Photography. Guest photographers may not be active during the ceremony and will not be allowed to photograph during family and individual portraits. Sarah Brianne Photography spends special time planning and posing your photographs and asks that guests not intervene.
Contract & Amendments
This agreement contains the entire understanding between Sarah Brianne Photography and the Client. It supersedes all prior and simultaneous agreements between the parties, including but not limited to emails, phone conversations, or conversations taking place in person. This contract may be amended if necessary, provided both parties agree to the amendments, and the amendments are submitted in writing. If the parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.
Consultations
The parties agree to pre-event consultations before the event date in order to finalize the actual shooting times, locations, and expectations. Consultations may be in person, over the phone or computer, or through email.
Wedding Date Organization
Sarah Brianne Photography will aid the Client in the creation of a wedding day schedule. The wedding day schedule will determine the beginning and ending times for photography and include but are not limited to the following: salon visits, preparation sites, pre-wedding family and wedding party photographs, ceremony, family photographs, location shots, and photography during the reception.
Wedding Day Contact
The Client will be responsible or have someone designated for identifying people for whom specific photographs are desired. The photographer will not be held accountable for not photographing desired people from any list if the desired people are not present, running errands, completing projects, or other tasks which preclude them from being found and available to be included in photographs. It is highly advised to have a close friend or family member assist the photographer in identifying specific family members, friends, or guests the Client has requested to be included in photos.
